The judge blocks the deployment of Trump National Guard troops in Portland

A federal judge blocked the efforts of President Donald Trump to deploy National Guard troops in Portland in a night decision on Sunday.

The American district judge Karin Immingut ruled that the action was illegal and unconstitutional, issuing an emergency temporary restriction order to stop the deployment of the California National Guard. The order also prohibits the use of troops from any other state or Washington, DC in Oregon.

Immerut's ruling says that the Trump administration action violates Federal Statute 10 USC §12406 and the tenth amendment.

“It seems to violate both 10 USC §12406 and the tenth amendment,” Imminut said during the procedure, according to Adam Klasfeld reports by Allrise News.

Immerut also pressed the lawyer of the Eric Hamilton Department of Justice on why the Department of Justice continued to pursue the movements of the troops.

“How could the Federalized National Guard of California not be against the tro I issued yesterday?” She asked.
“You are a court officer. Are not the accused avoid my request?”

Hamilton denied any irregularity, but offered a defense to which Immergut retreated.

“It must have a colorable statement that Oregon's conditions guarantee deploying the National Guard, does not.”

Oregon Scott Kennedy said he felt like “a rhetorical What-a-A-Mole” game “and that he referred to reports that Trump could be considering sending Texas National Guard troops to Chicago.

The DAJ representatives requested a stay, but Immerut denied both the stay and the administrative delay, saying that it was an “emergency” and that there were no new facts to justify the request to change their previous ruling.

“I am driving this in an emerging way with a limited informative session,” he said. “No new information has been provided about any new problem in Portland.”

The governor of California, Gavin Newsom (D), immediately took X to boast.

“Break: we had just won in the Court, again. A federal judge blocked the illegal attempt of Donald Trump to deploy 300 of our National Guard to Portland troops. The court granted our application for a temporary restriction order, stopping any federalization, relocation or deployment of any guard of the guard to Oregon of any state. The abuse of Trump's energy does not stand. He advised.

The Department of Justice has indicated that the ruling will appeal with arguments that the President retains the authority under the federal law to deploy the forces of the National Guard in cases of “internal disturbances.”
