A 28-year-old “runaway” migrant was arrested and charged with rape after being previously released by a state court, despite his criminal record for violence.
In a statement issued Friday from the U.S. Immigration and Customs Enforcement (ICE) field office in Boston, Massachusetts, announced the arrest of Jorge Luis Castro-Alvarado, who was arrested in Lynn, Massachusetts, on August 1.
The Boston office of ICE's Enforcement and Removal Operations (ERO) said the migrant “illegally entered the United States before proceeding to Massachusetts and allegedly victimized a resident here.” The Guatemalan immigrant had entered the United States without being inspected, admitted or paroled, ICE says.
Authorities are still determining exactly when and where Castro-Alvarado first entered U.S. soil. In February, ERO Boston filed an immigration detainer against Castro-Alvarado after he was arrested for assault and battery on a family or household member.

The immigrant was later convicted of assault and battery and sentenced to eighteen months in prison. The Lynn District Court later reduced the prison sentence to six months.
According to ICE, the Essex County Superior Court arraigned Castro-Alvarado on two counts of rape and indecent assault and battery against a person over the age of 14 in April. In defiance of the ICE detainer, the court later released the suspect on bond without notifying immigration officials.

“The Essex County Superior Court released Castro on bond without notifying ERO Boston despite an active immigration detainer,” ICE reported. “The court imposed several conditions on Castro's bond, including requiring electronic GPS monitoring before releasing him back into the community.”
“Castro posed a significant threat to members of our community,” ERO Boston Field Office Director Todd M. Lyons said in a statement. “ERO Boston will continue to prioritize public safety by apprehending and eliminating non-citizen threats to our New England neighborhoods.”
