The Public Broadcasting Corporation (CPB) sued President Donald Trump on Tuesday to avoid the termination of three members of the Board.
The CPB helps to finance public media corporations such as NPR and PBS, which the Trump administration has pointed out, since it seeks to reduce spending. Trump sought to eliminate three of the five members of the CPB Board of their positions, but the corporation responded with a lawsuit arguing that the president lacks authority to eliminate the members of the Board.
Trent Morse, the presidential personnel deputy director of the White House for the President's Executive Office, sent an email on Monday informing three members of the CPB Board who were “finished in force immediately.”

The CPB responded with a lawsuit filed in the United States District Court for the Columbia district. He appoints Morse, together with Trump and other administration officials, as accused.
The complaint repeatedly emphasizes the independence of the CPB, as established by the Public Radiodice Law of 1967. The CPB is asking the court to declare Morse's email “has no legal effect because the president does not have the authority to take such action”, and grants costs of the CPB and legal fees along with another relief considered only and appropriate.
Trump is still sure that he will prevail.
“As numerous courts they have repeatedly affirmed, the Constitution gives President Trump the power to eliminate personnel who exercise his executive authority. The Trump administration looks forward to the final victory on the subject,” said a White House spokesman for Fox News Digital.

The members of the CPB Board are appointed by the President and receive periods of six years. The lawsuit indicated that the Public Radiodice Law does not mention that the president can eliminate the members of the Board and omits the “typical legal provision when creating a federal agency that the members of the Board serve at the pleasure of the president.”
Trump is trying to eliminate the members of the Board designated by Biden, Tom Rothman and Diane Kaplan, along with Laura Gore Ross, who was appointed by Trump in 2018.

“In fact, in the course of its business, the CPB does not have the ability to regulate any aspect of public media, resolve disputes between the stations, issue content of public media stations or issue any form of judgment on any other entity or organization,” the complaint continued. “The CPB does not violate, and cannot, violate or help the capacity of the executive branch to carry out or implement the laws.”
