The former CEO of Theranos, Elizabeth Holmes, lost on Thursday her attempt to appeal her essay of sentence for fraud of 2022.
The United States Court of Appeals of the Ninth Circuit denied Holmes request from a new hearing before the original three judges panel that confirmed his conviction.
At the same time, the Court said that no judge in the Circuit Court had requested a vote on whether the complete court trial of the appeal.
The decision leaves Holmes with the Supreme Court as his last chance to undo his sentence. You will have to ask the court to listen to the case.
Holmes, 41, was sentenced in January 2023 to 11 years and 3 months in prison after being convicted of four electronic fraud positions in January 2022.
It was declared guilty of deceiving investors about Theranos' capabilities, the blood test company founded in 2003. The company collapsed after a history of Wall Street Journal described the company's struggles and closed in 2018.
Holmes and the former Executive of Therans Ramesh “Sunny” Balwani, who was sentenced to 13 years in prison for fraud charges, received the order to pay $ 452 million in restitution.
Balwani was the mentor of Holmes and former lover.
Holmes began to comply with his sentence on May 30, 2023, in a federal women's prison in Bryan, Texas. Since then the time of his sentence has been shaved. In July 2023, approximately two years were cut and in May 2024 his time was reduced in another four months.
Holmes, the rising star of Silicon Valley, has two children, one born before his trial in 2021 and the other after his sentence.
