ISLAMABAD: Reviewing the order issued by its single court last month, the Islamabad High Court (IHC) has “temporarily” restored the authority of the Islamabad chief commissioner to direct detention under Section 3 of the Maintenance of Public Order (3MPO). .

Delivered on Thursday by a two-member bench comprising IHC Chief Justice Aamer Farooq and Justice Tariq Mehmood Jahangiri, the verdict came after the court stayed its single bench's decision to restrain the commissioner Islamabad principal to exercise the 3MPO law.

The high court issued notice to the parties on the appeal of the administrator of Islamabad Capital Territory (ICT) and others against the decision.

Following the decision, he temporarily reestablished the authority of the Executive of the Federal Capital to process his intrajudicial appeal for protection.

The court, in its written order, stated: “The Chief Commissioner may continue to perform his duties in accordance with the Presidential Order in question.”

Last month, the single bench of Justice Babar Sattar declared “null and void” the issuance of arrest warrants under the 3MPO in connection with the arrest of Pakistan Tehreek-e-Insaf (PTI) leaders case. , Shehryar Afridi and Shandana Gulzar.

The chief commissioner and the Minister of the Interior, after the decision, filed an intra-judicial appeal against the sentence, of which the court notified the parties.

Justice Sattar's bench observed that the Islamabad executive has no authority to issue arrest warrants under the 3MPO as such powers should rest solely with the federal cabinet.
