ISLAMABAD: Former first lady and wife of Pakistan Tehreek-e-Insaf (PTI) founder Imran Khan Bushra Bibi on Monday filed a petition in the Islamabad High Court (IHC) against a petition filed by her ex-husband Khawar Maneka, contesting his marriage. with Khan.
In her plea, Bushra has asked the court to dismiss Maneka's petition alleging that her marriage to the PTI founder was “fraudulent” and un-Islamic.”
Last month, Maneka moved a district and sessions court in Islamabad challenging the marriage of Khan and Bushra Bibi. His plea came just a day after petitioner Muhamad Hanif withdrew a similar petition questioning the PTI chief's nikah “on technical grounds”.
However, Bushra Bibi, through her lawyer, Barrister Salman Akram Raja, has submitted her plea to the IHC dismissing the admissibility of the case and stating that a lower court has no jurisdiction to hear it.
In his plea, he mentioned that in their judgments the high courts declared that marriages in Iddat were irregular and not annulled.
The petition further challenged that Bushra's ex-husband filed a complaint with malice and for nefarious purposes, falsely claiming marriage during the iddat on the basis of false and fabricated documents.
According to Maneka, the petition said, he divorced Bushra on November 14, 2017 and verbally divorced her three times on April 15, 2017. While the former first lady moved into her mother's house in August 2017 and remained there until her marriage to PTI Founder on January 1, 2018.
In her plea before IHC, Khan's wife sought to declare Additional Sessions Judge East's January 11 order “null and void.”
He added that the case should be dismissed and the trial court's proceedings should be stayed until the lawsuit is decided.
Bushra and Khan's marriage 'un-Islamic', says Maneka
Bushra's ex-husband called the nikkah fraudulent and said the marriage was solemnized during her iddat (the time when a woman enters seclusion after a divorce or the death of her husband).
“The above-mentioned nikah and marriage ceremony were neither legal nor Islamic as they were solemnized without observing the iddah period…” reads the petition available on geo.tv.
In his petition against the fraudulent marriage, Maneka reiterated the allegations he made in the interview, accusing PTI chief Imran of ruining his entire life, “stigmatizing the petitioner and his family only to achieve his unethical and immoral objectives through intrusion into plaintiff's peaceful marriage.” life..”
“In light of the above, it is humbly requested that respondents number 1 [Imran Khan] and 2 [Bushra Bibi] be summoned and punished strictly in accordance with the law in the interest of justice,” the petitioner prayed before the court.
Maneka has also recorded his statement before the civil judge and a hearing of the case has been fixed for November 28.
