A judge from New Mexico has dismissed the demand for Alec Baldwin alleging that he was maliciously prosecuted, a year after the actor-producer was authorized by a criminal position for the death of “oxide” of the filmmakers of the film.
Baldwin alleged in a January demand that he was the victim of excessive prosecutors and police in New Mexico. Baldwin said he had become the scapegoat of celebrities of the State for the accidental shooting of photography director Halyna Hutchins.
The lawsuit occurred six months after a judge dismissed the involuntary position of involuntary homicide that Baldwin had been facing.
The former judge of the Judicial District Court of New Mexico, Mary Marlowe Sommer, ended Baldwin's trial last July after prosecutors learned potential evidence of Baldwin's legal team.
Baldwin's subsequent demand was addressed to the special prosecutor Kari T. Morrissey, 1st Dist. Atty. Mary Carmack-Altwies, deputies of the Sheriff of Santa Fe County and Commissioners of the County of Santa Fe.
The defendants were “blinded by their desire to condemn Alec Baldwin for all the wrong reasons, and any cost,” said his demand.
On Tuesday, a different judge dismissed Baldwin's claims against the State, citing a lack of activity in the case.
Third Judicial District. Judge Casey B. Fitch wrote that six months had passed since a “significant action” was presented in the case of Baldwin. Fitch gave lawyers 30 days to present a motion to keep the demand in motion.
The ruling occurs when legal procedures in the “oxide” shooting saga are ending.
In May, the Hannah Gutiérrez arms manager was released from prison after serving 14 months for his sentence for serious crime of involuntary homicide in the death of Hutchins in October 2021 on the set of the New Mexico film.
Baldwin's case was dismissed a year ago by a Marlowe Sommer, who since then retired, in what was supposed to be the third day of the actor's high profile trial.
Instead, their defense lawyers raised serious questions about how the agents and prosecutors of the Law of New Mexico managed evidence while assembling their prosecution.
Baldwin's lawyers accused the state of misconduct, pointing out a batch of unconscious bullets that a potential witness gave Sheriff's researchers in March 2024. Marlowe Sommer seemed furious for the management of evidence, which was not delivered to the defense, and dismissed the single position against Baldwin.
Earlier this year, when Baldwin's demand was filed, Morrissey said prosecutors had been aware of Baldwin's plans to sue New Mexico. She added: “We wait for our day in court.”
