Another approach is to rationalize the processes harmonizing the procedures, consolidating the unregistered rights, providing clearer orientation and introducing postponement provisions for up to 18 months. The proposals also aim to solve problems related to Brexit by offering practical solutions for designs that lost automatic protection of the United Kingdom-EU.

In terms of application and justice, a new track of small claims within the court of the Intellectual Property Company is suggested to allow the affordable resolution of the design disputes. Finally, to modernize for digital innovation, proposals recommend accepting CAD files and video evidence, update definitions and review the scope of protection for designs created by AI.

“The design is in the heart of everything we do as a creative nation. However, protecting brilliant design ideas has become unnecessarily complex. That is why we are consulting in the simplification of our designs. Foundation for the next wave of British innovation that will boost growth in the whole country,” Chris Bryant MP, Minister of Creative Industries, saying.

The authorities say that these changes could deliver the most significant reform in decades, ensuring that Great Britain designers are equipped to compete worldwide. The consultation responses will help shape the final policy options for the ministers.
